Service Overview

Its more common than you think

You're a tradie, a miner, a delivery driver - or just someone who needs their car to live their life - and now your licence is on the line. Maybe it's demerit points adding up, a speeding fine that feels way off, or something more serious that's ended up in court. Losing your licence isn't just inconvenient - for a lot of people in Darwin, it's the difference between keeping your job and losing it.

Let us protect your interests

Traffic law in the Northern Territory covers a wide spectrum - from infringement notices and demerit point accumulation all the way through to serious criminal charges like dangerous driving causing death. In Darwin and across the NT, where distances are vast and a licence is often essential to daily life and employment, a traffic charge isn't just a legal problem - it's a practical one that can affect everything from your ability to get to work to your long-term career prospects.

The NT's traffic laws and penalty regime have specific rules around demerit points, immediate licence suspensions, and court-mandated disqualifications that differ from other Australian states. Many people don't realise that traffic offences can result in criminal convictions, not just fines - and that a conviction on your record can have serious consequences down the line. Having a traffic lawyer in Darwin who understands the local courts and the NT system can make a significant difference to the outcome of your matter.

We act for clients across Darwin, Palmerston, Katherine, Tennant Creek, Alice Springs, and remote NT communities, handling everything from speeding fines and demerit disputes to serious charges involving injury or death. We know how to challenge the evidence, negotiate with prosecutors, and present compelling cases to the court. FAQ's

COMMON QUESTIONS WE HEAR

What happens if I accumulate too many demerit points in the NT?

If you accumulate 12 or more demerit points within a 3-year period in the NT, your licence will be automatically suspended. The suspension period depends on the number of points accumulated. During the suspension period you cannot drive at all, and driving while suspended is itself a criminal offence. Maleys can advise on whether any of the demerit points recorded against your licence can be challenged and represent you in any review or appeal proceedings.

Can I contest a speeding fine in the NT?

Yes. You have the right to contest a speeding fine in the NT by electing to have the matter heard in court. There are a number of grounds on which a speeding infringement can be challenged - including errors in speed measurement, issues with camera equipment, unclear signage, and procedural errors. However, contesting a fine carries the risk that a court could impose a higher penalty. Maleys can review the circumstances of your infringement and advise on whether a challenge is worthwhile.

Is dangerous driving a criminal offence in the NT?

Yes. Dangerous driving and reckless driving are criminal offences in the NT, not just traffic infringements. A conviction can result in imprisonment, a lengthy licence disqualification, and a permanent criminal record. Where the driving caused death or serious injury, the matter will be heard in the NT Supreme Court and the penalties are even more severe. Maleys provides experienced criminal defence representation for dangerous driving charges across Darwin and the NT.

What happens if I drive while disqualified in the NT?

Driving while disqualified in the NT is a criminal offence. If caught, you face a further period of disqualification, significant fines, and potentially imprisonment - particularly for repeat offences. The court takes driving while disqualified seriously because it directly defies a court order. If you have been charged with driving while disqualified, contact Maleys immediately for advice on how to manage the situation and minimise the consequences.

Can I get a hardship licence in the NT for a traffic offence?

No. Unlike some other states, the NT does not offer hardship licences. Once disqualified, your options are limited and there is no application you can make to keep driving for work or medical purposes during the disqualification period. That said, if you are facing a disqualification, it is worth speaking with a lawyer before it happens. There may be factors that can be raised in court to reduce the period or influence the outcome. Contact Maleys for advice before your matter is finalised.

What is the open speed limit in the NT?

The Northern Territory was the last jurisdiction in Australia to have an open speed limit however these roads have now been limited. While a general 130 km/h limit now applies on most NT highways. The NT's traffic enforcement is strict, and excessive speed charges are treated seriously. If you have been charged with an excessive speed offence in the NT, Maleys can advise on your options and represent you in court.

What happens if my traffic offence results in someone being injured?

Where a traffic offence results in injury or death, the consequences become significantly more serious. Charges such as dangerous driving causing serious harm or culpable driving causing death are indictable criminal offences heard in the NT Supreme Court, carrying maximum penalties of up to life imprisonment. These matters require experienced barrister representation. Maleys has the courtroom experience to defend serious traffic matters at the highest level of the NT court system.

How long does a traffic offence stay on my record in the NT?

Demerit points from traffic infringements in the NT are counted within a rolling 3-year period - after 3 years, older points no longer count toward the suspension threshold. However, criminal convictions from traffic offences - such as dangerous driving or driving while disqualified - will remain on your criminal record indefinitely unless a spent convictions order applies. Maleys can advise on the long-term implications of a traffic offence on both your driving record and your criminal history.
